Data privacy information relating to the production of photographs and animated pictures in the context of events (such as, for example, press events, trade-fair appearances and company events) of Lohmann & Rauscher GmbH & Co. KG

    We provide this advice to inform you, as someone participating in our events, about how your personal data will be processed in the creation and distribution or publication of photographs and animated pictures (videos). In addition, we hereby inform you of your claims and rights as a data subject. In so doing we are complying with our information obligations under Articles 13, 14 and 21, GDPR.

    3. What sources and data categories are processed for the event?

    We process personal data that we receive from you through your participation in the event. This relates to:

    • master data (e.g. names, addresses, dates of birth);
    • data connected to the holding of the event;
    • activities within the framework of the event,
    • photographs and videos within the context of your participation in the event;
    • where relevant, "EXIF” data, which are automatically created by digital cameras and stored with the pictures (e.g., location where or time when the picture was taken)

    4. For what purpose are your personal data processed?

    We process your personal data for internal reporting or communications; to present information about the event; to document the event, and for PR work.

    As part of this, the publication of photographs among Lohmann & Rauscher GmbH & Co. KG’s affiliates in the aftermath of the event on media such as the intranet and company network is also intended to inform the group’s employees about the activities.

    Unless you have specifically objected to this, individual photographs and videos may be used in online and print media and on social media channels (e.g., Facebook) in the aftermath of the event. These include, but are not limited to:

    5. On what legal basis are your personal data processed?

    The legal basis for the processing of your personal data is Article 6(1)(f), GDPR. The creation of photographs for internal reporting and presenting information about the event, and for the purposes of documenting the event, and for PR work represents a legitimate interest of ours that is not outweighed by your interests, fundamental rights or freedoms, which require the protection of personal data.

    For participants who are minors or participants with a disability that is discernible in the pictures, the legal basis is Article 6(1)(a), respectively Article 9(2)(a), GDPR. The processing occurs because you have given explicit consent to the processing of your personal data. Consent may be withdrawn at any time with future effect.

    6. With whom are your personal data shared?

    Within Lohmann & Rauscher GmbH & Co. KG and among affiliates of the Lohmann & Rauscher Group, employees having access to the intranet or company network receive your personal data as the recipients of reports and information.

    We share photographs with persons who assist with publication thereof. These may be, for example, photographers or representatives of the press who are reporting on the event for journalistic/editorial purposes.

    Similarly, service providers who are contractually subject to our instructions (“processors” under Article 28, GDPR) may gain access to your personal data for the purposes referred to above. These are, in particular, companies in the photography and IT services sectors.

    7. For how long are your personal data stored?

    Your personal data are processed and stored, where necessary, for the duration of the event and for the duration of reporting on the event. Your personal data are erased as soon as the purpose for processing ceases to apply.

    8. Are your personal data sent to a third country or to an international organisation?

    As stated in Clause 6, employees of affiliates of Lohmann & Rauscher GmbH & Co. KG may receive your personal data. Where these affiliates are based in third countries and no adequacy decision by the EU Commission exists for these countries, the data is protected on the basis of EU standard data protection clauses (under Document No. 2004/915 EC). We will provide you with a copy of these clauses upon request.

    9. What rights do you have as a data subject?

    As a data subject you have a right of access under Article 15, GDPR; a right to rectification under Article 16, GDPR; a right to erasure under Article 17, GDPR; a right to restriction of processing under Article 18, GDPR, and a right to data portability under Article 20, GDPR. In the case of the right to access and the right to erasure, the restrictions under Sections 34, 35, Federal Data Protection Act, apply. You have the right to lodge a complaint with a supervisory authority (Article 77, GDPR, in conjunction with Section 19, Federal Data Protection Act).

    The supervisory authority responsible for us is: The commissioner for data protection and freedom of information for Rhineland-Palatinate [Landesbeauftragter für den Datenschutz und die Informationsfreiheit Rheinland-Pfalz], Hintere Bleiche 34, 55116 Mainz. However, you have the option of lodging a complaint with a different supervisory authority.

    We notify all recipients to whom your personal data has been disclosed of each rectification or erasure of your personal data or restriction of processing under Articles 16, 17(1) and 18, GDPR, unless notification is impossible or associated with disproportionate expense. We tell you who the recipients are if you request this.

    10. Are you obliged to provide your personal data?

    No, no obligation exists for you to provide your personal data. Should you not wish there to be any photographs that include you, please let the photographer or event organiser know on-site. In such cases we would like to ask you to wear a neutral label provided by us so as to prevent photographs being taken or so we can separate out the photographs featuring you.

    11. Is there any automated individual decision-making, including profiling?

    No.

    12. Am I able to object to the processing of my personal data or withdraw my consent?

    You have the right to object at any time to the processing of personal data concerning you that occurs based on Article 6(1)(f), GDPR, on grounds arising from your particular situation. Where your personal data are processed for direct marketing purposes, you have the right to object at any time to the processing of personal data concerning you for such marketing.

    Under the first sentence of Article 7(3), GDPR, you have the right at any time to withdraw any consent given to us. The lawfulness of processing that occurred on the basis of your consent before it was withdrawn remains unaffected. Thus, withdrawal only ever applies to data processing planned for the time after withdrawal of consent. Withdrawal may be sent by post or e-mail and is not required to be in a set format. Should you lodge an objection, we will no longer process your personal data, unless this is permitted on other (statutory) grounds. However, where an objection occurs and no other facts exist to support consent, your personal data must be immediately erased at your request under Article 17(1)(b), GDPR.
